In chapter seven, â€Å"Spirited Away†: Race, Gender, and Murder in Oklahoma During the 1920s, it was about how a small but active group of African Americans appeared and fought for their rights when the twentieth century came around (pg. 135). According the author, when it came to the Jim Crow Laws in Oklahoma, it separated almost every aspect of life into white and colored. A number of them were quickly written into the states’ legal code and were founded on two basic principles. They were that African Americans were individuals that were not capable of success or failure, good or evil, but they were deviant and inferior. They were criminal and ignorant people that intended to harm the white race, and because of that segregation was needed. The second principle, behind the Jim Crow Law, was that because of their moral and cultural superiority, whites had the right to separate themselves from African Americans and to limit their upward mobility. With these laws based o n the assumption of African American inferiority creating segregation, crime and race became tangled and intertwined, and many saw vigilantism as a necessary check on black criminality (pg. 136). This, according to the author, asserted white superiority and that African Americans should say under them as an inferior race. However, with the influence of globalization in recent centuries, change has become intertwined with conflict. In many instances, a natural change is not enough. In Henry David Thoreau’s Civil Disobedience, he is writing to the American people. He is trying to spark a desire for change, for people to oppose their government without actions. He uses this work to criticize the American institution of slavery as well as the Mexican-American War. Thoreau is attempting to convey the importance of listening to one’s conscience over the laws, believing that it is more important to do what they feel is right rather than listen to the laws given by the majority. Thoreau feels that people should protest against their government, but not using violent actions. He is trying to persuade the people to voice their opinions and break the chain of majority rule. Thoreau is writing during the time of the war between the United States and Mexico, which took place between 1846 and 1848. He writes to oppose the government’s actions and policies during this time period. He refused to pay a tax that would support the war and was imprisoned for a day. Thoreau uses ethos, logos, and pathos to persuade his audience to agree with his view of the American government and to voice their oppositions. Thoreau has a very strong appeal to ethos, which shows the audience that the author is reliable and credible. He uses his firsthand experience with the American government by way of his night spent in jail for refusing to pay a tax that he did not agree with. My understanding to literary themes is going beyond what the title to the short story is. The short story theme I am going conduct on is â€Å"The Secret Life of Walter Mitty’ by James Thurber (1973). In this short story the literary elements being used is plot and symbols and the theme being full of distractions and disruption. In this daydream Mitty was a captain in a war plane facing heavy enemy artillery, Captain Mitty â€Å"The cannonading has got the wind up in young Raleigh, sir, â€Å"said the sergeant. (Clugston, 2010). Again awakened by his wife, who found him in the hotel â€Å"I’ve been looking all over this hotel for you†, said Mrs. Mitty. Asking him did he get all the to get list and what was wrong, she looked at him and said I am going to take your temperature at home. The final daydream followed and Mitty was facing a firing squad bravely. With the lighting of the cigar ette Mitty faced the squad proudly and was the Undefeated, inscrutable to the last. After reading this short story I realized every daydream he had was coming from a description of an object he hears. The daydreams Mitty had gone through to me caused all his drifting off to be harmful with his wife. The symbols brought forth failures and being successful to Mitty and yet allowed him to be different people in a very humorous, strange way. Essay: ENG 101 Romantic Love and Marriage Love for the opposite sex has always been a controlling factor for mankind. (Brown 2nd Paragraph) Even so, romantic love is a poor basis for marriage. Many married couples are often asked, â€Å"Why did you two finally decide to get married? † A question that is answered over seventy-five percent of the time with, â€Å"Well because we are in love. Some of which are the deciding factors for those individuals when they are faced with the choice of getting married or not. These myths are not only common to many Americans, but they are believed to be true as well. These myths, along with romantic love are as I stated earlier a poor basis for something as complex as marriage. There are several factors that should be considered and ever present within the relationship before a marriage should take place. Besides romantic love, commitment should be present before a couple makes the decision to get married. When you are committed to another person you are dedicated to them, but according to the Urban Dictionary commitment is what transforms a promise into reality. You are realistically making a choice to be responsible if you will, for another individual. Making the decision to stand by your significant other in all aspects of one another’s lives. You commit yourself to help that person aspire to their hopes and fulfill their obligations as well as their responsibilities. Unlike in the dating situation once you are married you are obliged to stay committed to our significant other. You can’t just utter the words, â€Å"Its over,† and expect to walk away with all of your responsibilities lifted. So, commitment is an important factor that should be present before a couple chooses to dedicate themselves to one another until â€Å"death do us part. † Trust, according to Webster’s Dictionary is defined as reliance on integrity, strength, ability, and the su rety of a person; confidence. As well as the confident expectation of something; hope. I’ve heard may people say, â€Å"Without trust a relationship is nothing. A statement that I agree with whole heartedly. In a relationship, especially in a marriage you have to have a level of trust for your partner. You have to know you can rely on that person, be confident within that persons strengths, abilities, and the sureness of their choices and decisions. On Monday morning he telephones his uncle Will who runs a travel agency in the Perth CBD that specialises in sports tourism called Kick-off Pty Ltd in order to organise the trip especially the flights and accommodation. Will sends the following email to Jordan at 11am Monday:Dear Jordan,Kick-off can supply airline tickets to the West Indies and accommodation in Antigua, Barbuda and Dominica which will allow you to attend a number of cricket matches and also have the opportunity to buy merchandise. You will arrive on Friday before the first match of the season and remain in the West Indies for a three week pe riod. The price is $12200. Answer1: Step 1 The issue in the above case relates to the communication of the acceptance by the offeror on which the validity of the contract depends. Step 2 In accordance to the general rules of contract under the Australian law, once an offer is accepted and communicated to the offeror the contract becomes valid (Willmott, Christensen and Butler 2005). Since in the given case the acceptance was supposed to be delivered through post, the postal rules of acceptance would be applicable. In the case of Adams v Lindsell (Adams v Lindsell 1818), the postal rule was established according to which under normal circumstances any acceptance needs to be communicated expressly to the offeror but in cases of postal delivery, the letter of acceptance once posted it is said that the offer is accepted in course of post. However, this postal rule was overridden in the Holwell Securities Ltd v Hughes (Holwell Securities Ltd v Hughes 1974). In this case the judge stated that the postal rule does not apply when the contract expressly states that the acceptance must reach the offeror. Step 3 Observing the given case, a contract was made between Jordan Mitchell and Kick-off Pty Ltd. when Jordan telephones his uncle about arranging a trip to watch the cricket matches, it was an invitation to offer. The letter that was sent by Uncle Will is the offer. Even though the offer was made through electronic post it was specifically mentioned that the acceptance must reach the offeror by postal delivery. Due to the presence of this clause it was essential that the acceptance be made through post which was accordingly done by Jordan. However, the acceptance letter did not reach the offeror due to some unavoidable circumstances that was beyond the control of both the parties. In such a case the postal rule would apply as the acceptance was posted and was in course of post. Step 4 With regard to the above scenario, when though the contract was not further completed by both parties, the agreement was a valid contract despite the fact that the acceptance did not reach the offeror on time. This is because the communication of the acceptance was done accordingly by the acceptor. Answer2: Step 1 The issue in the case is regarding the intention to create legal relations between the parties and the payment of adequate consideration. Step 2 In order to create a valid contract between two or more parties it is essential that the parties must have intention to create legal relations. Generally, the presence of consideration proves that the parties have the intention to create legal relations (Willmott, Christensen and Butler 2005). Usually, the presence of consideration will provide evidence of this - if the promisor has specified something as the price for the promise this - in most cases - carries with it an intention that the parties be bound (Willmott, Christensen and Butler 2005). Nevertheless, intention is still an independent condition and it needs to be considered separately. Further, there are also such cases where even though consideration is present there is no existence of any contract as the pre-conditions have not been fulfilled. To determine the contractual intention usually the objective approach is taken. In the case of Rose and Frank Co v. JR Crompton Bros Ltd (Rose and frank Co v. JR Crompton Bros Ltd 1925) it was stated that the rule is in order to create a contract there must be present the common intention of the parties to enter into a legal obligation which is mutually communicated either expressly or impliedly. Step 3 Due to the presence of family relation between Will and Jordan, it is essential to understand from the agreement whether the parties have the intention to create legal relations. First criterion is the presence of consideration in the agreement. Since the agreement mentions about the presence of consideration, it implies that the parties had the intention to create legal relations. Even though the element of consideration is present it is not sufficient to prove the presence of legal relations. In the given scenario, when the acceptance was not communicated Jordan did not sue the other party for breach of contract. Whereas Will gave him another offer for the next cricket season at a discounted price of $13900 due to their family relations. This establishes that the offer made later by Uncle Will was an informal agreement with no intention to create a legal relationship. However, in the first part, a formal mail was sent by Uncle to Jordan, which expressed stated about the agreement. Step 4 Analyzing the above circumstances it can be stated that in the first part when Uncle Will sends a formal letter and required a formal acceptance it depicted that both parties had the intention to create a legal relation.
